The case for Texas A&M: Why the Aggies will win on New Year's Eve

The Northwestern Wildcats have waited nearly 63 years to break their bowl drought. They will likely have to wait a little bit longer.

As inspiring as their late-season climb was, they were dealt a tough card with this Meineke Car Care Bowl of Texas matchup with Texas A&M. Not that NU's susceptible defense would have fared much better against Houston's red-hot offense in the TicketCity Bowl, but the Cats could be in for a very tough time against a talented Aggies attack.

Just like NU supposedly didn't finish 6-6, Texas A&M could have finished with a far better record than 6-6. Five of its losses were by a touchdown or less, and five of its losses came against ranked teams. While NU was losing to teams like Army and Illinois, Texas A&M was losing to slightly more impressive teams like Arkansas and Oklahoma State. The point is the Aggies are an intimidating team, a far better one than their record suggests.

Texas A&M's Achilles' heel isn't necessarily on the field. The Aggies fired coach Mike Sherman following their loss to the Longhorns. They subsequently hired Houston coach Kevin Sumlin, a truly great grab; the only problem is he doesn't start until next year. The Aggies are now in the awkward position of having defensive coordinator Tim DeRuyter at the helm for just one game: the Meineke Car Care Bowl of Texas. While hiring Sumlin may have been a great move for the future, the distractions can't help as the Aggies prepare for their bowl game. Sherman was apparently well liked in the clubhouse, and now his team must prepare for its crowning game without him.

Yet, as important as coaching stability is, what I'm worried about is NU's stability on the field. With senior cornerback Jordan Mabin out with a shoulder injury, the Cats will have to rely on Jeravin Matthews and Daniel Jones to keep one of the most talented passing offenses in the country in line. That's right, they will rely on a special teams player who was frequently picked on by opposing defenses and a redshirt freshman making only his second start to keep heavyweights like Ryan Tannehill and Ryan Swopes off the scoreboard. Tannehill finished the 2011 season with 3,415 passing yards and 28 touchdowns through the air, while Swopes piled on 1,102 receiving yards. Six-foot, four-inch wide receiver Jeff Fuller added 709 receiving yards and five touchdown receptions. Presumably, safety Brian Peters, at six-foot, four-inches himself, could match up with Fuller, but then who matches up with Swopes? And let's not forget that Peters' companion across the playing field, Ibraheim Campbell, struggled for much of the season. As good as he's looked in recent games, he cannot necessarily be trusted to hold a player like Swopes down. Campbell may have made the All-Big Ten freshman team according to Yahoo! Sports, but that doesn't necessarily make him an All-Big Ten quality safety.

No doubt NU will be able to score. The question is whether the Cats will be able to stop the Aggies. If the game turns into a shootout, the advantage has to go to Texas A&M. NU hasn't had much luck in offensive shootouts this season, dropping high-scoring games to Michigan and Iowa. Five of the Cats' six wins came when they held their opponents to 25 points or less. The one offensive shootout they won in 2011 was a 59-38 win over the Hoosiers, and we can all agree that Texas A&M is far better than an Indiana squad that finished 1-11. And if it were to turn into a close game, my money is on Randy Bullock to knock home the game-winning field goal. He won the Lou Groza Award as the best kicker in the country so he's certainly capable of winning a game against Northwestern.

It's sad to say, but if my instincts are correct, the Wildcats will begin 2012 in much the same way they've began every season for the past several decades: trying to break their endless bowl drought. And they'll no longer have Dan Persa to make it rain.

Argentina's leader faces thyroid cancer surgery

President Cristina Fernandez has thyroid cancer, but test results Tuesday show that it remains limited to a lobe in the right side of her neck, and has not metastasized or spread into her lymph nodes, her spokesman said.

Alfredo Scoccimarro said the cancer was discovered during a routine exam on Dec. 22, and that Fernandez received the results from follow-up tests hours before the announcement.

Fernandez, 58, will undergo surgery on Jan. 4 at the Hospital Austral in Buenos Aires and then take 20 days of medical leave, during which Vice President Amado Boudou will run the country. Meanwhile, she will keep up her normal routine, Scoccimarro suggested, noting that she will appear at several events on Wednesday as planned.

This kind of thyroid cancer is highly survivable, with more than 95 percent of patients living at least 10 years after detection, according to the U.S. National Institutes of Health.

The usual treatment is to surgically remove as much of the cancerous material as possible, and then follow up with radioactive iodide treatments, taken orally. This substance helps to destroy any remnants of the cancerous gland and provide for clearer images showing any additional cancer, the NIH said on its Web site.

After surgery, patients usually must take medicine ? levothyroxine sodium ? for the rest of their lives to replace a hormone that the thyroid glands produce. Blood tests every six to 12 months to measure thyroid levels also are recommended.

Fernandez is only the latest South American leader to be diagnosed with cancer. Presidents Fernando Lugo of Paraguay, Hugo Chavez of Venezuela and Dilma Rousseff of Brazil all have undergone treatments recently.

Presidential doctors Luis Buonomo and Marcelo Ballesteros said the operation will be led by Dr. Pedro Saco, chief of the surgery department at Hospital Austral and chief of the Head and Neck Service of the oncology institute at the University of Buenos Aires. Saco also trained in cancer centers in Houston and New York, the hospital said.

Thyroid surgery is not without risk: the NIH says a nerve that controls the vocal cords can be damaged, and doctors sometimes accidentally remove the parathyroid gland, which helps regulate blood calcium levels.

Mexican actor Pedro Armendariz Jr. dies at age 71 (omg!)

MEXICO CITY (AP) ? Mexican character actor Pedro Armendariz Jr. died Monday at the age of 71. There was no immediate confirmation of the cause of death.

Armendariz was best known for playing sly, sometimes cynical characters he endowed with wit and charisma. Armendariz played Gov. Riley in the 2005 movie "The Legend of Zoro," and had roles in 1989's "Old Gringo" and "Once Upon a Time in Mexico" in 2003.

President Felipe Calderon's office issued a statement lamenting Armendariz' death, calling him "a great actor who reflected well on Mexico at home and abroad."

The Mexican government news agency Notimex reported he died in New York City of cancer, but said his family had asked for their privacy to be respected.

He acted in more than 100 films, including the Mexican hit "The Crime of Father Amaro."

Consuelo Saizar, the president of Mexico's National Arts Council, lamented the death of Armendariz in her twitter account.

He had been married and divorced twice and is survived by several children.

Armendariz' father bore the same name and was a movie star during the "golden age" of Mexican films in the 1940s and 50s.

Military Wives Choir take Christmas top spot

The Military Wives Choir has marched to the top of the charts, taking the coveted Christmas number one spot.

Their single, Wherever You Are, sold 556,000 copies in the last week, more than the rest of the top 12 combined, the Official Charts Company said.

Gareth Malone formed the group for BBC2 programme The Choir, which climaxed with the group performing at the Festival of Remembrance at the Royal Albert Hall.

Proceeds from the single are being donated to the Royal British Legion and the Soldiers, Sailors, Airmen and Families Association (SSAFA).

The choir?s success was announced during the festive edition of BBC1?s Top Of The Pops.

Kim Jong Il?s son called ?supreme leader? of North Korean military

PYONGYANG, NORTH KOREA ? North Korea hailed Kim Jong Il?s son as ?supreme leader? of the 1.2-million strong military, ramping up its campaign to install the young man as the nation?s next leader even as millions continue mourning the father a week after his death.

Kim Jong Un made a third visit Saturday to the palace where his father?s body is lying in state ? this time as ?supreme leader of the revolutionary armed forces? and accompanied by North Korea?s top military brass, according to the official Korean Central News Agency.

The new title and public show of support from the military leadership sent a strong signal that the nation will maintain Kim Jong Il?s ?military first? policy for the time being.

Earlier Saturday, the newspaper Rodong Sinmun, mouthpiece of the ruling Workers? Party, urged Kim Jong Un to accept the top military post: ?Comrade Kim Jong Un, please assume the supreme commandership, as wished by the people.?

Kim Jong Un, who is in his late 20s and was unveiled in September 2010 as his father?s choice as successor, will be the third-generation Kim to rule the nation of 24 million. His father and grandfather led the country under different titles, and it remains unclear which other titles will be bestowed on the grandson.

Kim Il Sung, who founded North Korea in 1948, retains the title of ?eternal president? even after his death in 1994.

Son Kim Jong Il ruled as chairman of the National Defence Commission, supreme commander of the Korean People?s Army and general secretary of the Workers? Party.

Kim Jong Un was promoted to four-star general and appointed a vice chairman of the Central Military Commission of the Workers? Party. He had been expected to assume a number of other key posts while being groomed to succeed his father.

His father?s death comes at a sensitive time for North Korea, which was in the middle of discussions with the U.S. on food aid and restarting talks to dismantle the North?s nuclear weapons program. Chronically short of food and suffering from a shortfall in basic staples after several harsh seasons, officials had been asking for help feeding its people even as North Koreans prepared for 2012 celebrations marking Kim Il Sung?s 100th birthday.

North Korea has emphasized the Kim family legacy during the sped-up succession movement for Kim Jong Un. State media invoked Kim Il Sung in declaring the people?s support for the next leader, comparing the occasion to Kim Jong Il?s ascension to ?supreme commander? exactly 20 years ago Saturday.

At the Kumsusan Memorial Palace, Kim Jong Un and senior commanders paid silent tribute to Kim Jong Il, ?praying for his immortality,? KCNA said. The military also pledged its loyalty to Kim Jong Un, the report said.

?Let the whole army remain true to the leadership of Kim Jong Un over the army,? KCNA reported ? a pledge reminiscent of those made when Kim Jong Il was named supreme commander.

The call to rally behind Kim Jong Un, dubbed the ?Great Successor? in the wake of his father?s death on Dec. 17 from a heart attack, comes amid displays of grief across North Korea. The official mourning period lasts until after Kim?s funeral Wednesday and a memorial Thursday.

In Pyongyang, mourners waited in line Saturday to bow and lay flowers at Kim?s portrait at plazas and government buildings, including the Pyongyang Circus Theater and the April 25 People?s Army House of Culture, even as temperatures dropped to 14 degrees below Celsius (7 degrees Fahrenheit).

Workers at beverage kiosks handed steaming cups of water to shivering mourners, including children bundled up in colourful thick parkas. A sign urged mourners to thaw out inside a heated bus. The order to provide food and warming huts for mourners came from Kim Jong Un, officials said.

Earlier, a throng of North Koreans climbed steps and placed flowers and wreaths in a neat row below a portrait of Kim Jong Il as solemn music filled the air and young uniformed soldiers, their heads shaved, bowed before his picture.

A sobbing Jong Myong Hui, a Pyongyang citizen taking a break from shovelling snow, told AP Television News that she came out voluntarily to ?clear the way for Kim Jong Il?s last journey.?

For days, life in Pyongyang had come to a standstill, with shops and restaurants closed. Downtown Koryo Hotel, one of several in Pyongyang catering to foreigners, was nearly empty.

But there are signs that the country is beginning to move on.

?Streets, buses and the metro are all crowded with people going to their work. They are not giving way simply to sorrow,? KCNA said. ?They are getting over the demise of their leader, promoted by a strong will to closely rally around respected Comrade Kim Jong Un.?

Among the mourners Saturday was a son of the Rev. Sun Myung Moon, founder of the South Korean-based Unification Church, which has long-standing ties with North Korea. The Rev. Hyung-jin Moon helped carry a wreath to the main mourning site at Kim Il Sung Square in central Pyongyang.

The Korean Peninsula has remained in a technical state of war since the Koreas? 1950-53 conflict, but two groups from South Korea have permission from the South Korean government to visit the North to pay their respects, Unification Ministry spokesman Choi Boh-seon said Saturday in Seoul.

One group will be led by the widow of former president Kim Dae-jung, who held a landmark summit with Kim Jong Il in 2000, and the other by the wife of a late businessman with ties to the North.

Citizens in Pyongyang, meanwhile, received a last gift from the late Kim Jong Il: fish. State-run media said Kim was worried about the supply of fish and had looked into the matter the day before he died.

Rodong Sinmun showed a photo of a woman covering her mouth as she watched herring and walleye being distributed at a crowded grocery store where they were piled up in baskets.

Nelly?ran up a $20,403.64 credit card bill with American Express -- which seems totally reasonable for a big name rap star. Just one problem ... AMEX says he never paid it!

The credit card company filed a lawsuit against Nelly (real name Cornell Iral Haynes, Jr) in Missouri back in October to try and get their money back (plus another $3,000 in attorney's fees). So far though, they claim Nelly has refused to pay what he owes.

A court hearing is scheduled for January 9. Calls to Nelly's camp were not returned.

Android Phone Pictures Can Be Stunning, Too

Everyone wants to take the best photo possible and capture the moment in a memorable-favorable way. But a lot of people?s pictures look amateur at best, terribly blurry at worst. Raise your skills to the next level by following a few simple photographic tips. Even with your smartphone, you?ll be surprised to find a new level of quality to your photographic endeavors.

Here are a few tips for taking better pictures on your Android:

  • Keep the camera away if you?ve had more than three drinks. Once you?ve moved down the road towards having a good buzz, your focus and image stability have gone. Do yourself a favor and only shoot photos if your hand is steady and sober.
  • Speaking of steady, use both hands to hold your phone when snapping a pic. You don?t try to hold a ?real? camera with one hand while capturing a memorable image. Why handicap yourself while using a convenient phone-based medium?
  • Don?t snap a picture against the light source. Whether it?s a light bulb, Christmas lights, or the sun, pointing your Android phone towards a bright light source destroys the image before you even try to take the picture. That?s because the light overwhelms the lens aperture. Find the light source, then position yourself where the brightest light source is behind you. Additional tip: A steady light provides a much better lighting prospect than does a flash.
  • When touching up your photos, think ?effects? rather than trying to capture the stark reality. High-resolution digital images have a propensity to reveal every flaw in a scene. Focus instead on softening and fading, creating a ?feel? rather than peeling off the layers to reveal every detail.
  • Avoid using the digital zoom. Digital zoom simply cuts material out of your picture, bringing a small ?box? of the total image forward. Instead, try to move closer to your subject.
  • If you look around and everyone else is taking the same shot with their Android, don?t be just another one doing the same thing. Try to capture the moment by stepping back a few steps, and take a picture of all of your friends taking the same picture. Images that garner people?s attention need to add some detail that other pictures lack.

By putting a tiny amount of thought into your picture taking, you can begin snapping better photos on your Android in no time. Avoid the simple mistakes of blurry images, backlit images, and unoriginal image composition, and you?ll quickly notice how it is easy to shoot like a pro!

Gas tubing fires linked to lightning spark concern (AP)

WESTERVILLE, Ohio ? Reports of lightning-related fires and gas leaks in at least a dozen states have sparked concerns about the use of flexible gas lines made of corrugated stainless steel tubing.

The same type of lightning strikes is suspected of causing fires in four homes in central Ohio over a stormy 12-hour period this summer. Genoa Township Fire Chief Gary Honeycutt said he believes lightning struck at or near the homes, and the electrical charge traveled along the plastic-coated metal tubing, known as CSST, before jumping to a less resistant pathway nearby such as a metal ventilation duct. It then punctured a hole the size of a pencil tip in the tubing and created a gas leak that could ignite, he said.

One of the fires charred the ceiling in the lowest level of Michael Wagner's dream home, a two-story property near a country club and golf course in an area where farmland has been turned into neatly manicured neighborhoods of newer homes.

"It had been burning the joists much like a blowtorch," said Wagner, whose family moved into the home a few weeks before the fire and has been displaced for months because of smoke damage. The home passed inspection without problems, they said, but they later learned lightning had struck it and created a gas leak in 2004.

Reports of such fires and gas leaks, ranging from such states as Florida, which has a high occurrence of lightning strikes, to those where strikes are less frequent, have led to lawsuits, studies and efforts to better track the incidents. Manufacturers defend CSST, which has become increasingly common in new homes since it was introduced domestically more than two decades ago, and fire officials and researchers are trying to determine whether to blame a faulty product, unsafe installation or something else.

Firefighters and gas providers point out that the fires seem to occur with an unusual combination of factors ? a newer building that has CSST, a lightning strike in just the right place, the puncture of the tubing and the spark to ignite the gas. Most of the Ohio fires were in the central part of the state, though it's possible there are others that haven't been linked to the tubing because the reports didn't include that detail.

"I'd say we've got a problem with that product, but it's very anecdotal evidence that we have," said state Fire Marshal Larry Flowers, who recently started collecting information about such fires around Ohio.

A class-action lawsuit filed in Arkansas against several manufacturers claimed the tubing posed an unreasonable risk of fire from lightning strikes, leading to a 2006 settlement that was worth up to about $29 million, according to a copy of the settlement agreement provided by an attorney not affiliated with the case. Lawyers involved in the case did not respond to messages for comment.

And an unresolved wrongful death lawsuit blames a CSST failure for a 2008 blaze that killed three children and their grandmother in rural Jefferson, S.D.

"For a homeowner or a business owner, really the problem with the product is it's very unpredictable when it's going to fail, and it's a very difficult product to make safe," said Mark Utke, a lawyer with the Cozen-O'Connor firm in Philadelphia, which is working on the South Dakota case and dozens more it connects to CSST.

Manufacturers say the flexible tubing was developed in Japan as an alternative to rigid gas piping that could break during an earthquake, and hundreds of millions of feet of tubing have been installed in U.S. homes and other buildings. It can cost significantly more than black metal pipe, with one recent estimate putting the cost at 65 cents for a foot of rigid pipe in Ohio and about a dollar more for standard CSST. But the tubing is easier to install and can bend around corners, appearing much like a garden hose affixed to ceiling joists.

Both types of lines meet existing product and code requirements, but manufacturers say that CSST is the safer option and that it's less likely to crack, leak or cause a gas explosion because it doesn't require as many joints to follow the shape of a building's interior.

"Of course we would like everything in the house to be safe from lightning, but that's not a requirement," said Bob Torbin, the director of codes and standards for Exton, Pa.-based Omega Flex Inc., one of the producers targeted in lawsuits. "And so we have to ask ourselves: Does this represent an unreasonable risk compared to other risks that you take when you occupy your home?" That's a measurement that's tough to quantify, he said.

In response to concerns, Omega Flex stopped offering its earlier CSST product this fall and instead is promoting tubing wrapped in a special covering intended to make it more resistant to lightning strike damage.

Some manufacturers and builders say there may be other contributing factors in the tubing fires, including whether gas lines are correctly grounded and bonded, meaning they're linked into a system that would direct energy from a lightning strike into the earth.

The president of the Ohio Home Builders Association said he has used the tubing and has no doubt that it's a safe product when installed properly.

"We have it in our home," said Bill Owens, who's also founder and president of Owens Construction in suburban Columbus. "A lot of it is just paying attention to the actual installation requirements and the code requirements associated with safe installation."

In Indiana, officials increased code requirements for bonding and grounding in new homes and expanded the required gap between gas tubing and other metal items to help decrease the risk of a problem. The research foundation affiliated with the National Fire Protection Association, which sets national codes that pertain to construction, is studying how to mitigate any lightning-related dangers of CSST and has sought information from various stakeholders in the discussion, including manufacturers and insurers.

"Now that it's out there, how do we make it safe?" said Mitchell Guthrie, an engineering consultant from Blanch, N.C., who has researched CSST and lightning protection and worked with a panel studying concerns.

Iowa Fire Marshal Ray Reynolds said people in the insurance industry have linked the tubing to more than 200 fires in his state over the past two years, and he doesn't believe proper grounding and bonding is the only solution. He said Iowa has seen some problems with properly bonded systems, and he decided to replace the tubing in his own home with the updated, extra-protected CSST.

Wagner, the Ohio homeowner displaced by a fire, said he decided to replace his flexible tubing with rigid lines to help his family feel safer.

The American Gas Association, which represents gas providers, doesn't think CSST is a defective product, but it has helped develop product standards and has supported the industry's effort to educate the public about concerns and to minimize any dangers.

"It's just a situation that could occur, just like lightning could penetrate a home and damage wiring," said Jim Ranfone, the AGA's managing director of codes and standards.

"It's not a panic situation, but it's one that I would sort of keep tabs on to make sure the system was properly bonded," he said.

Iranian exiles ready to leave Iraq camp (AP)

PARIS ? The head of an Iranian exile group says more than 3,000 of its members holed up in a camp in eastern Iraq are ready to leave if they get U.S. and U.N. security guarantees.

Paris-based leader Maryam Rajavi said in a statement Tuesday that Camp Ashraf residents are "in principle prepared to relocate to Camp Liberty" ? a recently vacated former United States military base ? if their safety can be guaranteed.

The armed People's Mujahedeen Organization of Iran moved to the camp during the regime of Saddam Hussein, who saw them as a convenient ally against Tehran. They were disarmed by U.S. soldiers during the Iraq invasion in 2003, and have since become an irritant to Iraq's Shiite-led government, which is now trying to bolster ties with its neighbor.

The United Nations has said that at least 34 people were killed in an April raid on the camp by Iraqi security forces, and Iraq authorities have vowed to close the facility by Dec. 31.

The Obama administration ? hoping to avoid a possible violent standoff with Iraqi authorities ? urged the residents Monday to accept a U.N.-brokered deal to move to the temporary site near Baghdad airport where arrangements would be made for them to resettle elsewhere.

The Iranian dissidents have previously resisted leaving, saying they fear persecution at the hands of Iraqi authorities, and sought an extension to the Iraqi deadline.

But on Tuesday, Rajavi said for the move to Camp Liberty to be completed, the "minimum guarantees for the residents' safety and well-being in order to prevent a recurrence of violence and bloodshed until the residents are resettled in third countries" must be given.

The group said Rajavi had sent a letter Dec. 10 to President Barack Obama and U.N. Secretary-General Ban Ki-moon outlining the guarantees the dissidents are seeking, including security protection during and after the move by the U.S., European or U.N. forces ? not by the Iraqi government.

U.S. officials said Monday that the new facility would remain under Iraqi government control, but come under U.N. supervision. Residents not wanting to return to Iran, or live in third countries to which they have family ties, would be able to apply for U.N. refugee status, they said.

The People's Mujahedeen has been branded a foreign terrorist organization by the U.S., a designation now under review by the State Department. It has been removed from similar blacklists in Europe.

Mexican city to begin countdown for Dec. 21, 2012 (AP)

MEXICO CITY ? A city in southern Mexico wants to live each moment as if it were the last.

Tourism officials in Tapachula have installed a digital clock to count down the time left before the Dec. 21, 2012, solstice, when some believe the world will end.

The clock starts Dec. 21, a year before the supposed apocalypse.

Chiapas state tourism regional director Manolo Alfonso Pinot said Friday that Mayan priests will perform a ceremony at the nearby archaeological site of Izapa.

Maya experts say the doomsday fears are a misreading of Maya stone inscriptions that mention the date, saying the Mayans only considered it the end of one calendar cycle and the beginning of another.

Pinot said he doesn't believe the world will end, but looks at it as a sort of beginning, in the business sense at least.

"A lot of people know they can fill their body with energy if they come to these exceptional sites," he said. "If people are interested, we have to take advantage of this."

Tapachula, best known as a gritty border town crossed by Central American migrants en route to the United States, is not a popular Mayan tourism destination. But nearby Izapa is a place where many stelae have been found, including the "Tree of Life" stone discovered in the 1950s and thought to convey an ancient Mayan tale.

At Izapa, close to the Tajumulco volcano, Pinot says a Mesoamerican ball court, a carved stone and the throne of the Izapa ruler face a straight line that on Dec. 21, 2012 is expected to align with the planets.

"It is hard to say what you will be able to see that day," he said.

The doomsday theories stem from a pair of tablets that describe the return of a Mayan god at the end of a 13th period of 400 years, which falls on Dec. 21, 2012.

Experts say the date marks the end of a 5,125-year cycle that began in 3113 B.C., and the start of another.

Editorial: What's wrong with TV, and what it might take to change it

America's favorite pastime, and perhaps that of all first-world countries, has yet to be truly rocked by technology. Sure, there have been a few true advancements like on-demand, streaming and the DVR, but only about 30 minutes of the average seven hours of TV Americans watched in 2010 was time shifted. Forty percent of homes have a DVR today, but most are just using them as tapeless VCRs. The reasons are complex and can't be summed up easily, but most would agree that DVRs and streaming options are where smartphones and MP3 players once were: plenty of people are throwing things against the wall, but nothing's sticking. I don't have the answers, but I do understand what the problem is and what it might take to change it. I can only hope that such a proposed change could become a self-fulfilled prophecy.

McQueary gives graphic Sandusky testimony

A Penn State assistant football coach testified Friday that he believes he saw former assistant coach Jerry Sandusky sexually molesting a boy but said he wasn't 100 percent sure it was intercourse.

Mike McQueary, speaking for the first time in public about the 2002 encounter, said he truly believes what he saw in a Penn State locker room was anal sodomy.

McQueary took the stand Friday in a Pennsylvania courtroom against two school officials accused of lying to a grand jury about the child sex-abuse allegations against Sandusky.

McQueary told the court on Friday that he had gone into the building one night in 2002 after watching a football movie at home, which he said had motivated him to go into the building and get some work done, reported NBC News.

When he went into the locker room, McQueary said heard slapping sounds, "skin on skin."

In the locker room, McQueary said he saw Sandusky behind a boy he estimated to be 10 or 12 years old, with his hands wrapped around the boy's waist. He said the boy was facing a wall, with his hands on it.

He said he peeked into the shower several times and that the last time he looked in, Sandusky and the boy had separated. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."

The position was very "sexually oriented," McQueary said Friday, according to NBC News, but he told the court he couldn't say with "100 percent certainty it was forced."

His testimony came during a preliminary hearing for two school officials accused of lying to a grand jury about child sex-abuse allegations against former coach Jerry Sandusky.

McQueary told a grand jury that he told the administrators, Tim Curley and Gary Schultz, that he saw Sandusky sodomize a boy in a locker room shower in 2002.

Curley and Schultz are charged with lying to a grand jury and failing to properly report what McQueary allegedly told them. Their lawyers say the men are innocent and contest McQueary's statements.

Deciding Curley and Schultz' next steps
District Judge William C. Wenner was hearing testimony Friday to help him decide whether state prosecutors have enough evidence against the pair to send their cases to trial.

Sandusky says he is innocent of more than 50 charges stemming from what authorities say were sexual assaults over 15 years on 10 boys in his home, on Penn State property and elsewhere. The scandal has provoked strong criticism that Penn State officials didn't do enough to stop Sandusky, and prompted the departures of Hall of Fame football coach Joe Paterno and the school's longtime president, Graham Spanier.

Curley, 57, Penn State's athletic director, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.

Curley and Schultz testified to the grand jury that McQueary never relayed the seriousness of what he saw and that they told Spanier what they knew before telling Sandusky not to bring children on to campus.

McQueary has not been charged in the case but was put on administrative leave from the university, as was Curley. Schultz retired shortly after he was arraigned November 7 in suburban Harrisburg.

Paterno and Penn State President Graham Spanier were fired for not telling police what they knew.

Sandusky waived his preliminary hearing on Tuesday and will go straight to trial on 52 counts of alleged sex abuse of boys over a 15-year period.

"We anticipate Mike McQueary will be at the hearing," said Martine Charles, a spokesperson for the attorneys representing the university administrators.

Unlike Sandusky, Curley and Schultz are not expected to waive their preliminary hearing before District Judge Wenner.? They deny the charges. Sandusky also says he is innocent.

Mugger left bloodied after attempt on MMA fighter

Chicago police say Anthony Miranda tried to rob an MMA fighter.

CHICAGO -- A convicted felon decided to mug an MMA fighter on the Southwest Side of Chicago, police say, and ended up paying a steep price.

Police did not release the victim's name but said he was able to ward off Anthony Miranda, 24, who ended up with two black eyes and a gunshot wound to the ankle after a tussle.

The victim was sitting in his parked car near 55th St. and Kenneth when Anthony Miranda, 24, walked up to the car asking for a lighter, according to the Chicago Sun-Times.


When the victim did not have one, Miranda pulled out a handgun and demanded money, police officials said. He then demanded the victim get out of the car.

At some point, the victim was able to grab control of the gun while Miranda's attention was diverted. The two men wrestled on the ground and during the fight, Miranda accidentally discharged his gun, shooting himself in the ankle, police said.

The victim was able to pin down Miranda until police arrived and later told officials he was a martial arts expert and ultimate fighting champion.

Miranda was taken to Holy Cross Hospital with a face full of cuts and two black eyes, police said. He has been charged with armed robbery and aggravated discharge of a firearm, a class X felony.

Records show Miranda has several convictions, including at least one for a residential burglary. He was ordered held on $350,000 bond Sunday.

(AP) ? Virginia Tech says it acted appropriately in alerting the campus that bloody spring day in 2007 during what turned out to be the deadliest mass shooting in modern U.S. history.

The government disagrees and has levied $55,000 in fines, contending the school was too slow in notifying students, faculty and staff and therefore in violation of a federal law requiring timely warnings when there are safety threats.

The university gets a chance Wednesday to begin making its case before an Education Department administrative judge, Ernest C. Canellos, in hopes of erasing a fine that isn't hefty but can leave a black mark on an institution's record.

The fines were levied under a law known as the Clery Act, which requires colleges and universities to provide warnings in a timely manner and to report the number of crimes on campus. During the Obama administration, there's been a ramping up in enforcement under the act, which has gotten recent attention because of scandals at Penn State and Syracuse.

Investigators have been on the Penn State campus for a Clery Act investigation into whether the university failed to report incidents of sexual abuse in connection to allegations against former assistant football coach Jerry Sandusky. An Education Department spokesman said the department is also reviewing whether a similar investigation will take place at Syracuse. Three men, including two former ballboys, have accused former assistant basketball coach Bernie Fine of molesting them as minors.

In the Virginia Tech case, the rare hearing is expected to last two or three days. It probably won't end with an immediate ruling and further legal challenges could follow. Virginia Tech hasn't indicated it is backing down even though experts say schools found in violation of the law typically accept a fine and agree to changes or negotiate a settlement.

This has attracted great interest in higher education circles, given the high profile nature of the crime and the chance to learn how the department applies the law. The 1990 law was named after Lehigh University student Jeanne Clery, who was raped and murdered in her dorm room by another student in 1986.

During this administration, the Education Department has conducted more random Clery Act audits and has worked at times with the FBI. Six schools this year alone are facing fines, which is the same number that paid fines in the first 18 years of the law, said S. Daniel Carter, director of public policy at Security on Campus Inc., a Wayne, Pa.,-based organization formed by Clery's parents.

The maximum fine per violation under the law is $27,500. Colleges and universities can also lose the right to offer federal student loans, but that's never happened. In the highest fine issued under the Clery Act, Eastern Michigan University agreed in 2008 to pay $350,000 for covering up the rape and killing of a student in her dorm room by telling reporters and her parents there were no signs of foul play.

In the Virginia Tech case, the university opted to exercise its right for an appeals hearing before an Education Department administrative judge. Larry Hincker, a university spokesman, said in an email that the actions taken by Virginia Tech were well within the practices in effect then on campuses.

Virginia's attorney general, Kenneth Cuccinelli, said in a statement earlier this year that the appeal was filed to compel the department to treat Virginia Tech fairly. The university contends the department is holding it to a higher standard than what was in place at the time of the shootings.

"There are important principles and policies at stake here that affect not just Virginia Tech, but colleges and universities all across the country," Cuccinelli said in the statement.

The university is facing charges of failure to issue a timely warning and failure to follow its own procedures for providing notification.

"This case is about responsibility," the Education Department said in a court filing. "Specifically, it's about an institution's responsibility to provide vital information to its students and employees as required by federal law."

The department said the university violated the law by waiting more than two hours after two students were shot to death in a residence hall before sending out a campus wide warning by email. The department said the email was too vague because it mentioned only a "shooting incident" but did not say anyone had died. By that time, student gunman Seung-Hui Cho was chaining shut the doors to a classroom building where he killed 30 more people and then himself.

At the time the email was sent, the university has argued it was believed the two students were shot in an isolated domestic incident and that the shooter had left the campus. The school also contends it had planned a news conference to discuss the residence hall shootings until the later shootings intervened.

"This case is not one in which Virginia Tech was avoiding its responsibilities, but rather one in which it responded in a variety of ways that are permissible under the applicable regulations," the university said in a court filing.

Some family members of the students killed have called the fines woefully inadequate. Suzanne Grimes, whose son Kevin Sterne, was injured in the shootings, is scheduled to testify. She said in a telephone interview that university officials failed in their duty to warn students.

"The families of the deceased have a lifetime of grief and the survivors like my son, Kevin, have a lifetime of injuries and what the future holds for them, as a mother I'm concerned about," Grimes said.

Peter Lake, an education law professor at Stetson University College of Law, said higher education officials believe that what happened at Virginia Tech could happen on any campus. At the same time, university administrators are aware that enforcement of the Clery Act has increased, he said.

"It will be very interesting to see what the arguments are and how they are perceived," Lake said. "I think the field is very much on high alert. They are trying to figure out what's happening next."

While the Virginia Tech hearing may prove instructive for other schools on the Clery Act, a more applicable example on how such cases work involved a review at Tarleton State University in Stephenville, Texas, Carter said.

The Virginia Tech case focuses on what happened related to a specific incident, while Tarleton State's covered broader issues, which is more typical, Carter said.

The Education Department fined Tarleton State $137,500 in 2009 for allegedly underreporting the number of sexual assaults, burglaries and drug-related crimes on and near the campus between 2002 and 2007. The university appealed.

There wasn't an evidentiary hearing, but after reviewing the evidence, Canellos reduced the fine to $27,500. The case was appealed to Education Secretary Arne Duncan, who has not issued a decision.
