Stahl arrested for investigation of lewd conduct

(AP) ? Los Angeles police say actor Nick Stahl has been arrested for investigation of lewd conduct.

The 33-year-old "Terminator 3" star was arrested about 8 p.m. Thursday on Hollywood Boulevard. He was booked on a misdemeanor count of lewd conduct and released from custody.

The Los Angeles Times reports (http://lat.ms/YU6uBO) that Stahl was arrested at an adult movie shop during a routine undercover police operation.

In May, Stahl had been reported missing by his wife, but he later turned up.

Stahl was a child star who performed in the 1993 film "The Man Without a Face." He also has appeared in the 2003-2005 HBO series "Carnivale'" and starred in "Mirrors 2" in 2010. An email seeking comment from his publicist was not immediately returned Friday.

(AP) ? Zac Posen is in on "Project Runway" ? he'll be the new featured judge, filling the chair Michael Kors sat in for the show's first 10 seasons.

"This was an amazing opportunity," Posen said. "I hope I'm here to give a new perspective to the designers."

Kors isn't "out" ? as host Heidi Klum likes to say to the fashion-design contestants who get the boot on the granddaddy of fashion reality TV shows. His schedule didn't allow a commitment, but he will come back as a guest judge for the season finale, according to a statement for Lifetime TV.

Posen said he learned from Kors. "When I was a guest judge, I saw he was always a generous, warm mentor."

Posen's best skill to offer the contestants is his sharp eye, he said. Craft and construction are among his passions, he explained, so nothing gets past him there.

It's Klum's role in the new lineup to bring the voice of the woman who might be the eventual customer. Nina Garcia, the fashion director at Marie Claire, has her editorial eye, and Posen analyzes the specifics of the design, he said.

Posen, however, also sounded a little jealous of Tim Gunn, who has the part of trusted adviser. "I wanted to be behind the scenes with Tim. ... I was seeing the clothes on the runway, but Tim had all the background interaction."

The silver lining? Posen said he'll appreciate a little more what the stylists, editors and retailers are looking for as they sit in the front row for his own catwalk shows, which last season drew much attention for a model lineup that included Naomi Campbell, Coco Rocha and Karolina Kurkova ? a threesome getting their own TV reality show this winter called "The Face" on the Oxygen network.

Another twist to the revamped "Project Runway," in which the winner gets $100,000 to start their own brand, is that the contestants compete as teams instead of individuals.

"You can imagine the designers' reactions when we first told them," Klum, an executive producer, said, "but it resulted in some really interesting conflicts and partnerships. And that is how designers work in the real world ? they do have to work on teams and manage teams ? you get to understand their personalities more."

Posen said he aims to be a collaborative player and appreciates what everyone else at his company does, although he is the starting and stopping point of each look that bears his label.

He'll be at the studio solo next week over the holidays, sketching and draping fabric with the music "thumping": It's one of the most wonderful times of the year, he said.

The "Project Runway" season starts Jan. 24.

'Raiders of the Lost Ark' package mystery solved

(AP) ? First, there was "Raiders of the Lost Ark." Now, there's "Mailers of the Lost Package."

Days after the University of Chicago announced it had received a replica of the journal from the film "Raiders of the Lost Ark," the school says it has solved an international mystery with its roots in Guam.

A few weeks ago, a journal addressed to one Henry Walton Jones, Jr. ? the given name of Hollywood's Indiana Jones ? was placed inside another package and mailed from Guam to Italy, where someone had bought it on eBay.

But the smaller package fell out and was spotted by a U.S. postal worker, who saw it was addressed to Jones at the University of Chicago. The worker added the Chicago zip code and sent it on its way.

Upon its arrival at the school's admissions office, officials didn't know what to make of the package. There is no Henry Walton Jones Jr. on the faculty.

It took a student doing a bit of research on the Internet to discover that Jones was real ? on big screen. Indiana Jones' character is said to be based loosely on two U of C professors. Abner Ravenwood was an Egyptologist and archeologist at the school about a century ago. In the movie, he is a mentor of Indiana Jones, and the journal is his.

Though the craftsmanship of the journal, chock full of maps and old photographs, was impressive, a spokesman for the school's admissions office said, there were clues that indicated Ravenwood was not the author.

"The photos were of Harrison Ford during filming," said spokesman Garrett Brinker.

The school found out the journal was the work of a Guam man whom Garrett described as a "prop replicator."

"Apparently, it takes him two weeks to make one of these replicas and then he sells them to people all over the world," Brinker said. "He says they usually go for about $200 (but) I believe this one went for $177."

Brinker said that the Oriental Institute, the university's famed museum and organization devoted to the ancient Near East, likes the journal and asked to display it in its main lobby.

"They asked for it and now it is in their possession," he said.

Can birds make us happy?

Dec. 17, 2012 ? As millions of us post our Christmas cards -- many of which star a robin red breast -- ecologists are investigating whether birds make us happy. Speaking at this week's British Ecological Society Annual Meeting, researchers will reveal how they are investigating the links between birds and our well-being, and explain how their results -- due out next year -- could have a major impact on UK bird conservation.

There has been an increasing amount of research on the health benefits of green spaces such as parks and nature reserves, but we know far less about how the wildlife within these habitats contributes towards well-being benefits.

Take wild birds for example says PhD student Natalie Clark from the University of Reading, who is leading the study: "Most of us say we enjoy seeing wild birds in our local environments every day, be that the friendly robin visiting our garden each Christmas or ducks swimming in the local pond. But we have little idea of how much we value their presence and how they're contributing to our overall well-being."

Given the declining numbers of many bird species the study -- which also involves the University of East Anglia, the RSPB and the University of Chicago -- is timely. "Any well-being benefit we may be receiving could soon be in jeopardy as numbers of many wild bird species have declined across the UK since the 1970s," says Clark.

"We know that wild birds are very important to a significant proportion of people living in the UK, with more than 60% of people with a garden providing supplementary food to birds. What we need to understand next is how and to what degree wild birds are benefiting people in the UK, so that we can work to conserve these birds and the well-being benefits they provide for future generations. This is particularly important at a time when many of us are feeling the 'economic pinch' and will appreciate benefits from increased well-being to an even greater degree."

Participants from across the UK have been filling in questionnaires designed to find out how often they visit green spaces and why, and to measure how differing levels of bird activity near people's homes may be affecting their well-being.

According to Clark: "We're really interested in the reasons why people visit green spaces and how important different aspects of wildlife, particularly birds, are to their outdoor experiences. That friendly robin hopping across your lawn might be more important than you could imagine."

Results from the study are expected in the spring, and the three and a half year project is funded by the Natural Environment Research Council, with additional support from the RSPB.

Natalie Clark will outline the study on Tuesday 18 December 2012 to the British Ecological Society's Annual Meeting at the University of Birmingham.

Family decorates float to honor late son at Rose Bowl Parade

Quinn's is one of 72 floral portraits that will adorn the Donate Life?float, "Journeys of the heart," honoring the lives?and gifts of organ and tissue donors.?

TOLEDO -- Quinn Vittorio Wilde was less than three months old when he a seizure disorder took his young life.?Quinn's family will honor his memory aboard the Donate?Life float at the Rose Parade this January in Pasadena, California.

After seizures stopped his breathing in the middle of the night, Quinn's parents rushed him to the hospital. Testing later confirmed the infant?had no brain activity, and was?taken off life support on?June 7, 2008.??

Quinn's?parents, Denien and Patrick Wilde,?decided to donate his heart valves?with help from?Toledo's?Community Tissue Services, one of the largest tissue banks in the United States.

"It was a way to honor his life and his memory, and a way to reach out and help others," said Denien Vittorio Wilde.

Denien Wilde soon?found out that two children's lives were saved because of Quinn's tissue donation.?In collaboration with Community Tissue Services, the American Association of Tissue Banks?offered?to sponsor?Quinn's family on the Donate Life float at the 2013 Rose Parade.

"She's a great speaker and she can really connect with people," said Reg Dawson, Executive Director?for Community Tissue Services. "We asked if she would be interested in representing Quinn at the Rose Bowl Parade."

On Monday, family and friends put the final touches on a floragraph of Quinn. It is one of 72 floral portraits that will adorn the Donate Life?float, "Journeys of the heart," honoring the lives?and gifts of organ and tissue donors.

"The design of the float is open hearts, and the honoree's portraits will line the hearts on the float," said Denien Wilde. She continued, "It symbolizes the different ups and downs of?different families' journeys through the donation process and the process of grieving."?

Although Denien Wilde will?represent?Quinn on the float herself, her mother and daughter?will?also make the trip?to Pasadena to show their support on January?1.?

WASHINGTON (AP) ? Big differences remain, but there is finally movement in long-stalled talks on avoiding the "fiscal cliff."

House Speaker John Boehner is offering $1 trillion in higher tax revenue over 10 years and an increase in the top tax rate on people making more than $1 million a year. He's also offering a large enough extension in the government's borrowing cap to fund the government for one year before the issue must be revisited ? conditioned on Obama agreeing to the $1 trillion in cuts.

The offer, made Friday after a long impasse between Boehner, R-Ohio, and President Barack Obama, calls for about $450 billion in revenue from increasing the top rate on million-dollar-plus income from 35 percent to the Clinton-era rate of 39.6 percent.

The additional revenue would be collected through a rewrite of the tax code next year and by slowing the inflation adjustments made to tax brackets.

In return, Boehner is asking for $1 trillion in spending cuts from government benefit programs like Medicare. Those cuts would defer most of a painful set of across-the-board spending cuts set to slash many domestic programs and the Pentagon budget by 8-9 percent, starting in January.

Boehner also continues to press for a less generous inflation adjustment for Social Security benefits, a move endorsed by many budget hawks. Obama and Democrats on last year's deficit "supercommittee" endorsed the idea in offers made last year, but they're more reluctant now.

Democrats rejected the offer and some say an increase in the Medicare eligibility age is a non-starter. They are also pressing for extended jobless benefits for the long-term unemployed.

Boehner's proposal was described by officials familiar with it. They required anonymity because of the sensitivity of the talks.

The movement comes as an increasing number of Republicans have called for a tactical retreat that would hand Obama a victory on his longstanding campaign promise to raise taxes on households making more than $250,000 a year. That increase, combined with an increase in the tax rate on investment income from 15 to 20 percent, would raise about $800 billion in tax revenue over a decade.

In that context, Boehner's move could be seen as an attempt to get spending cuts linked to the rate increase rather than giving them up and getting nothing in return.

Still, the Boehner offer is sure to cause unrest among many conservative Republicans dead set against raising tax rates at all.

Obama has offered $600 billion in spending cuts over a decade, including $350 billion from federal health care programs and $250 billion from other cuts to domestic programs like farm subsidies and the pension program for federal workers, and through sales of used federal property.

Obama and Boehner met Thursday in a session described as "frank" by both sides. Boehner's offer and a follow-up phone call came the next day ? amid increasing speculation that Republicans might move on to a plan B in which they would give Obama a win on tax rates for upper-bracket earners and renew the fight when increasing the government's borrowing cap, which needs to be done soon, probably in February.

Boehner's $1 trillion cut proposal would be paired with a comparable increase in the borrowing cap, enough to keep the government borrowing for about a year. But if the cuts are smaller, the debt limit increase would be smaller as well.

"Our position has not changed. Any debt limit increase would require cuts and reforms of a greater amount," said Boehner spokesman Brendan Buck.

Obama originally sought $1.6 trillion in new tax revenue over a decade and has since revised that to $1.4 trillion. He would probably go lower, a decision fueled in part by resistance from Democratic allies in the Senate to Obama proposals like taxing capital gains and income at rates equal to earned income.

Democrats to have open primary for Jackson seat

CHICAGO (AP) ? Chicago-area Democratic officials have failed to unite behind a single candidate for former U.S. Rep. Jesse Jackson Jr.'s seat in Congress.

Robert Storman, a spokesman for one of the Cook County Democratic officials voting in Saturday's slating session, says none of the more than a dozen candidates was able to get a majority of votes. That means the Democrats will have an open primary.

Jackson resigned from the U.S. House last month, citing his battle with bipolar disorder.

Among the Democratic candidates to replace him are a state senator recently arrested for carrying a gun into Chicago's O'Hare International Airport and a former congresswoman who challenged Jackson earlier this year.

The primary is set for Feb. 26. The general election will be April 6.

The first change concerns the application of a directive that forbids sex discrimination in the pricing of insurance products. This ban has been imposed through a European Union directive drawn up following a case brought to the European Court by a Belgian consumer group and will apply as of December 21.

Another serious reason for the premium hikes is the revision of life expectancy charts that insurance companies base their calculations on. The charts, which show expected longevity per age group, were recently updated by the Bank of Greece and will apply from the start of 2013. Both men and women are now expected to live longer than in the past and this will be reflected in insurance policies.

Regarding sex discrimination, to date, women have paid higher premiums for pension products than men, as the fact they tend to live longer meant they would need more money in order to amass the stock to secure them the pension agreed with the insurance firm, which must be paid for more years than in the case of men.

One would have expected that this would lead to a reduction in women?s premiums and an increase in men?s, but that is not the case. The reason for that is the life expectancy charts, whose application pushes premiums higher for both sexes.

For example, previously, a 40-year-old man signing a new pension contract would pay 2,215 euros a year to secure 500 euros a month at the age of 65, but with the new tariffs he will have to pay 3,475 euros per annum, while a 30-year-old woman paying premiums of 1,560 euros a year to get a 500-euro pension when she hits 65 will now have to pay 2,280 euros per annum.

This dramatic hike in premiums for men and women is also attributed to a third factor: This is the interest rate on which guaranteed pension, which the insurance company is committed to paying, is calculated. The downward course of the markets has seen all investments by insurers yield less, forcing them to reduce their rates. That means that the insured will have to pay more money now to amass the required amount by the end of their working years.

Egyptian protesters clash over draft charter

CAIRO (AP) ? Egyptian Islamists brandishing swords clashed with opponents of a draft constitution Friday in the Mediterranean city of Alexandria as tensions rose on the eve of a referendum on the sharply disputed charter that has plunged the country into weeks of turmoil.

At least 19 people were reported injured in the violence in Alexandria, which broke out after an ultraconservative cleric urged worshippers to vote "yes" and described the opposition as "followers of infidels."

The crisis pits Egypt's newly empowered Islamists against the country's mainly liberals and supported by a large sector of apolitical moderate Muslims. Both sides stepped up their campaigns after weeks of violence and harsh divisions that have turned Saturday's vote into a fight over Egypt's post-revolutionary identity.

Critics already have raised concern over the legitimacy of the document after most judges said they would not supervise the vote as stipulated by law. Rights groups voiced fears of fraud and the opposition said a decision to stretch the vote two rounds to make up for the shortage of judges left the door open for initial results to sway voter opinions.

On Friday, thousands of Islamists filled a square in northern Cairo, raising pictures of President Mohammed Morsi, who has insisted the referendum will begin on Saturday as scheduled despite accusations the entire process has been rushed. A few kilometers (miles) away, the opposition chanted for a "no" vote in a sit-in, exposing the deep rifts.

Religious authorities had issued orders that mosques should not be used to manipulate the vote, but several clerics, especially in conservative southern areas, took to the pulpit to tell their congregations that voting in favor of the constitution is seeking victory for Islam.

"Voting yes is like jihad for the sake of God," Sheik Abdel-Akher Hamad told worshippers in the southern city of Assuit. "It preserves Egypt from evils and from those who want to sabotage Islam and Muslims."

The crisis began when Morsi, who hails from the Muslim Brotherhood, issued a decree on Nov. 22 giving himself and the assembly writing the draft immunity from judicial oversight so the document could be finalized before an expected court ruling dissolving the panel. The panel has been disbanded before over illegality of its composition since it included lawmakers.

On Dec. 1, the densely written document was then passed by an 85-member assembly mostly composed of Islamists in a marathon session despite a walkout by secular activists and Christians. Morsi rushed it to a vote scheduled for the next two Saturdays, compounding the crisis.

Many also fear that it would be next to impossible to amend the constitution if the draft passes and Islamists continue to dominate the parliament in upcoming elections.

According to the draft, articles 217 and 218 state that the president and parliament have the right to make a "request" to "amend an article or more," then parliament must discuss the request within 30 days. Two thirds of parliament members are needed to pass the request. Then parliament has 60 days to finalize the amended articles, and a third of parliament is needed to pass the final text before putting them to a national referendum.

Most of Egypt's judges are refusing to monitor the vote, according to the powerful Judges union, although authorities said they would be able to meet the legal obligation to have a judge at each polling station.

More than 51 million people are registered to vote, with more than 6,000 polling stations in 10 provinces, including Cairo and Alexandria in the first round on Saturday.

"Polling stations can't open their doors unless there is a judge there," Zaghloul el-Blashi, the head of the referendum committee, told the pan-Arab TV station Al-Jazeera.

The Carter Center, the international group founded by former U.S. President Jimmy Carter that has been monitoring Egyptian voting since last year's uprising, also said it would not deploy monitors for the referendum because of the government's late release of monitoring regulations.

The opposition coalition The National Salvation Front reiterated its call for Morsi to postpone the referendum and form a new assembly to draft a new constitution.

"History will remember that this regime forced a referendum on the people of Egypt in these harsh circumstances," said Ahmed Said, leader of liberal Free Egyptians Party and part of the coalition opposition. "They can't find judges to monitor, (there is a) rift among Egyptians and blood on the streets."

The crisis also has united the long fractured opposition, which had considered boycotting the referendum but instead officially launched a campaign Thursday calling on voters to go to the polls and reject it. They voiced fears of fraud.

"We know well that the rigging operation is beginning from now. There are creative ways. They are counting on the lack of awareness among the people," Sameh Ashour, an opposition member, said Friday.

Clashes broke out in at least two cities after fiery sermons promoting a vote for the constitution as a vote for Islam.

Sheik Osama el-Hawi, a member of the ultraconservative Islamic sect known as Salafis, told worshippers approval of the constitution was the only way to restore stability after nearly two years of turmoil following the revolution that ousted Hosni Mubarak.

"Saturday will be the day of victory for Shariah (Islamic law)," he said.

His followers then briefly fought with protesters marching outside the mosque after prayers in Nagaa Hammadi, 460 kilometers (290 miles) south of Cairo.

In Alexandria, witness Mustafa Saqa said Sheik Ahmed el-Mahalawi, a well-known Salafi, gave a sermon in which he described the opposition as "followers of infidels" sparking tension that quickly devolved into fist fights and street battles that spread into residential areas. State TV showed footage of Islamists brandishing swords as protesters hurled rocks at each other.

A health official, speaking on condition of anonymity because he wasn't authorized to release the information, said at least 19 people were injured.

Morsi, who took office in June after a narrow victory in the country's first free elections, joined weekly Friday prayers at the el-Farouk mosque near his house in eastern Cairo and left without giving a speech.

The cleric at his mosque remained neutral.

"Those who think that rejecting or approving the constitution is the path to heaven or hell is mistaken," he said, referring to a slogan constitution supporters have used. "No one rules whether someone goes to heaven or hell but God almighty."

On Friday, Islamist members of the assembly that drafted the constitution held a presser on Friday in which they accused opposition of spreading "lies and calls for discord."

"This is political blackmail that is not based on any evidence or reality," said Amr Darrag, a leading member of the Muslim Brotherhood's political arm Freedom and Justice.

But in many ways, the pros and cons of the draft constitution have been overshadowed by the worst crisis to hit Egypt since the overthrow nearly two years ago of Hosni Mubarak's authoritarian regime. Newspaper and TV commentators have warned of a country moving toward civil strife and a schism that may not be bridged.

The opposition took out advertisements in newspapers and on television detailing their arguments against the charter. The Morsi camp's message was far simpler. A "Yes" to the constitution is a yes to Islam.

Sheik Mohammed Sayyed, affiliated with the Muslim Brotherhood, put it bluntly during prayers at the el-Helali mosque elsewhere in Assuit. "Tomorrow is the day we will seek victory of Islam," he said.

"The first phase of implementing Shariah (Islamic law) is the election of a Muslim president. The second phase is to hold referendum on the constitution," he said, urging voters to go to the polls in groups. "Those calling themselves liberals and salvation of Egypt, are saboteurs who sabotage Egypt."

Sun's X-Rays Reveal New Twist

Astronomers are a step closer to figuring out a vexing problem with X-ray observations of the sun. There is less iron ? specifically, less iron in one prominent spectral light feature ? than expected.

The discrepancy arises whenever an X-ray telescope examines the sun's light spectrum, or that of any star. Highly charged iron dominates the sun's spectrum in certain wavelengths, according to researchers. But the iron is weaker than expected.

For decades, a debate has been raging regarding this. Some scientists think incomplete modeling of collisions in the sun's gas, or plasma, is why we see less iron than models predict. Others say the discrepancy is due to problems in how the atomic physics is calculated.

New research from an international team, led by the Max Planck Institute of Nuclear Physics in Heidelberg, Germany, suggests it's the atomic model to blame. [Video: Star (X-Ray) Light; Star (X-Ray) Bright]

"This is something special [that we found]. This is no deviation," said Sven Bernitt, a researcher at the institute and the lead author of the paper. The research appears in the Dec. 13 edition of the journal Nature.

Faraway physics

The challenge with looking at the sun (or any star, for that matter) is we can't easily get up close to measure its properties. Astronomers rely on spectroscopy ? splitting light into its constituent wavelengths ? to pick out the individual elements that make up a star.

The sun is mostly made up of hydrogen and helium, but there is a small but mighty iron core at its center. The amount of iron will increase as the sun gets older, as scientists have observed in other stars in the universe.

"All the information we get from a star is from the radiation," Bernitt said.

Experimentally reproducing the sun's environment in X-rays was difficult until fairly recently, Bernitt added. Only one facility capable of doing this exists in the world right now: Stanford University's Linac Coherent Light Source at the National Accelerator Laboratory.

The 2-mile long linear accelerator, also known as a linac or free electron laser, has created a new kind of X-ray pulsing laser made possible by pushing electrons to extremely high energy.

According to its creators, the accelerator's X-ray pulses are a billion times brighter than what humans were capable of generating previously in synchrotrons, a type of circular particle accelerator.

"This is the best light source of its kind in the world," Bernitt said. "It's really unique, so we saw our chance to go there and do an experiment."

'Beam time'

Bernitt's team hauled a 3.5-ton electron beam ion trap ? equipment that includes a magnetic chamber ? from Germany by plane, and fitted it into the Stanford linac in California.

With dozens of hours of "beam time" to work with, the researchers produced a cloud of highly charged ions in their chamber. They shot X-rays on this ion cloud using the free electron laser, which allowed them to probe the atomic structure of the ions.

The researchers measured the "fluorescence intensity ratio," or the excitation, of two spectral features of the energized atoms. The instrument allowed them to study the excitation level of individual atoms without regard to the energy produced by particle collisions commonly found in the sun's plasma.

"It was a very clean, pure experiment," Bernitt said. His team found that iron excitation of one energy level was lower than expected, suggesting that the atomic calculations for iron will need to be refined.

No immediate follow-up work is planned due to the expense and time involved, Bernitt added, but his team hopes to resume work on this topic sometime in the future.

There is at least one institution in Germany that is planning a similar free electron laser. If it becomes functional, this could cut down on Bernitt's team's transportation costs.

When Roger Goodell appointed Paul Tagliabue to hear the Saints? bounty appeal, the players fought to get the ex-NFL commissioner to recuse himself. There was no way, they thought, that Tagliabue would kneecap his successor, invalidating the suspensions that Goodell had pronounced from his unassailable lair atop Commissioner Mountain. But on Tuesday, Tagliabue sided, amazingly, against the man sitting behind his old desk, vacating the suspensions of four current and former Saints. Though he affirmed many of Goodell?s original findings of player misconduct, this is the equivalent of a teacher writing ?nice job? in the margin of a D paper. Goodell got it wrong in every way that matters. He conducted an unfair investigation that reached bad conclusions based on faulty evidence, then crowed sanctimoniously about his findings. Now, at last, this story has the ending it deserves, with the power-hungry commissioner undone by his quest to demonstrate just how powerful he can be.

Viewed narrowly, Tagliabue?s ruling absolves Jonathan Vilma, Will Smith, Scott Fujita, and Anthony Hargrove because NFL players follow orders or get cut. ?Coaching legends such as George Halas and Vince Lombardi are not glorified or remembered because they offered players ?freedom of choice,? ? Tagliabue writes. In the case of the Saints, it was coaches like Gregg Williams who ?conceived, encouraged and directed the program,? destroyed evidence off of team computers, and told players to lie about it to NFL investigators. The players, by virtue of their being employees rather than employers, should not be punished for doing what they?re told to do.

But Roger Goodell didn?t botch this case because he misunderstands the NFL?s chain of command. Tagliabue's write-up reveals, carefully and methodically, that Goodell ignored league precedent during the bounty probe. Rather, he used the investigation as a vehicle to talk tough on gridiron crime and present player safety as an issue of profound concern to the league, imperiled only by the players themselves. Nine months ago, the commissioner wrote that he was ?profoundly troubled by the fact that players ? embraced this [bounty] program so enthusiastically? and that ?while all club personnel are expected to play to win, they must not let the quest for victory so cloud their judgment that they willingly and willfully target their opponents and engage in unsafe and prohibited conduct intended to injure players." These passages, it turns out, offer a better sketch of the NFL boss than the behaviors he was tut-tutting. In parceling out punishments without regard to logic or history, it was Goodell, not the players, who acted over-enthusiastically. It was Goodell, not the players, whose judgment was clouded.

Consider the case of Scott Fujita. On May 2, the league announced that the former Saints and current Browns linebacker was suspended for three games because he ?pledged a significant amount of money to the prohibited pay-for-performance/bounty pool during the 2009 NFL Playoffs. ? The pool to which he pledged paid large cash rewards for ?cart-offs? and ?knockouts,? plays during which an opposing player was injured.? Five months later, Goodell reduced Fujita?s suspension to a single game, explaining that while ?I have not found that you directly contributed to the bounty pool, there is no serious question that you were aware of the pool and its elements.?

Even as he walked back his initial claims, however, the commissioner mounted a smarm offensive. "I am surprised and disappointed by the fact that you, a former defensive captain and a passionate advocate for player safety, ignored such a program and permitted it to continue,? Goodell wrote to Fujita.

This has been the NFL?s consistent line of attack: If the evidence turns out to be flimsy, wag your finger all the more vigorously. The league suspended Hargrove, NFL general counsel Jeff Pash explained in June, in part because footage of the 2009 NFC Championship Game showed the defensive lineman saying ?give me my money.? A month later, when it became clear it wasn?t Hargrove?s voice, Goodell claimed that the "identity of the player who made the statement ? did not affect the level of discipline imposed on Mr. Hargrove.?

Tagliabue?s ruling, by contrast, comes from an alternate NFL universe in which the flaws in the case actually matter, and the arbiter?s self-calibrated disappointment level is not determinative of the outcome. Fujita?s actions, as the ex-commissioner explains, were neither surprising nor disappointing. Now that the league has admitted there?s no evidence the linebacker paid cash for ?cart-offs,? his behavior is no different than that of other players who reward their teammates off the books. Tagliabue points to similar cases involving the Packers and Patriots in 2007 and 2008 in which the teams, not players, were punished (with small fines, not suspensions) for pay-for-performance pools. ?Accordingly, the NFL's decision to suspend a player here for participating in a program for which the League typically fines a club certainly raises significant issues regarding inconsistent treatment,? Tagliabue writes, saying that Fujita?s ?actions here were not conduct detrimental.?

Tagliabue also implies that Goodell?s self-righteousness trumped sanity with regard to Hargrove and Smith. The former was suspended eight games (later reduced to seven) for denying the existence of a bounty program?something his coaches urged him to do. But as Roger Goodell saw it, Hargrove was guilty of the worst crime of all: lying to Roger Goodell. Yes, Michael Vick was guilty of leading a dogfighting ring. But as a league source explained to Yahoo?s Jason Cole in 2007, "Where [Vick] is in the most trouble is that he lied to the commissioner.?

More than anything else, his hardline stance on honesty reveals that Goodell sees himself as a parent rather than a jurist. It?s important that a kid tell his mom and dad the truth, and he should be grounded for another couple of days if he doesn?t fess up to breaking that lamp. It?s not always the best strategy for a defendant to say everything he knows, however, and he shouldn?t get put away just because he pleads not guilty. As Tagliabue writes, ?In my forty years of association with the NFL, I am aware of many instances of denials in disciplinary proceedings that proved to be false, but I cannot recall any suspension for such fabrication.? (In the document?s most hilarious twist, Tagliabue also notes that Brett Favre was fined, not suspended, for obstructing a league investigation into his sexting practices. As a consequence, Goodell wildly over-punished Hargrove for obstructing an investigation into a bounty on Brett Favre.)

The answers are easy?

It?s getting the questions right that is hard.

I?ve talked to four business owners over the last few days about the challenges with their marketing.

And each of those conversations started with this question:

?So how do you think I should be advertising?social media, TV, radio, direct mail??

It?s the wrong question.

See, the media you use is irrelevant unless and until you have a clear (and I mean CRYSTAL CLEAR) understanding of WHO your ideal client is (and who your ideal client is not).

But that?s not enough.

You also need to know, with all the certainty of the sunrise in the east, what big hairy problem their having today that you can solve for them.

So the questions to ask are?

Who is ideally suited to the solution I offer? Why?

What value do they derive from my solution? Why is it valuable to them? (The reasons are not usually obvious.)

How valuable is it to them? Worth sacrificing to get, or just nice to have?

How do THEY talk about their problem? All of you experts reading this are especially afflicted (I?ve been there too) because you talk in gibberish only you understand.

Why should they buy from you and not the guy or gal down the street?

Why don?t they buy from you? (Many sales to be made with the answer to this question.)

Answer these and THEN you can ask?

Where can I find them? Using what media?

Any earlier and the answers are irrelevant.
